CENTRO DE BUCEO ARENAL SL is the CONTROLLER responsible for processing the USER’s personal data and informs them that such data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD).

Depending on the form through which we have obtained your personal data, we will process it confidentially for the following purposes:

To respond to queries or any type of request made by the user through any of the contact methods made available on the controller’s website.

How long will we keep your personal data?

The data will be kept for no longer than necessary to maintain the purpose of the processing, or for as long as there are legal provisions requiring its retention. When the data is no longer necessary for these purposes, it will be deleted using appropriate security measures to guarantee the anonymisation of the data or its complete destruction.

To whom do we disclose your personal data?

No disclosure of personal data to third parties is planned, unless necessary for the development and execution of the purposes of the processing, to our communication-related service providers, with whom the CONTROLLER has signed the confidentiality and data processing agreements required by the current privacy regulations.

What are your rights?

The rights available to the USER are:

Right to withdraw consent at any time.
Right of access, rectification, portability and erasure of their data, and the right to restrict or object to its processing.
Right to lodge a complaint with the supervisory authority (www.aepd.es) if they consider that the processing does not comply with current regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

By ticking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form, or provided in download forms, USERS expressly, freely and unequivocally accept that their data is necessary for the provider to deal with their request, while the inclusion of data in the remaining fields is voluntary. The USER guarantees that the personal data provided to the CONTROLLER is truthful and undertakes to communicate any changes to it.

The CONTROLLER informs users that all data requested through the website is mandatory, as it is necessary to provide an optimal service to the USER. If all data is not provided, it cannot be guaranteed that the information and services supplied will be fully adapted to the user’s needs.

3. SECURITY MEASURES

In accordance with the provisions of current personal data protection regulations, the CONTROLLER complies with all provisions of the GDPR and LOPDGDD regarding the processing of personal data under its responsibility, and expressly with the principles described in Article 5 of the GDPR, according to which data is processed lawfully, fairly and transparently in relation to the data subject, and is adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed.

The CONTROLLER guarantees that it has implemented appropriate technical and organisational policies to apply the security measures established by the GDPR and LOPDGDD in order to protect the rights and freedoms of USERS, and has provided them with the appropriate information so that they may exercise those rights.

SOCIAL MEDIA PRIVACY POLICY

1. USER INFORMATION

Who is responsible for processing your personal data?

CENTRO DE BUCEO ARENAL SL, hereinafter the CONTROLLER, informs the USER that it has created profiles on the social networks Facebook, Instagram, Twitter, LinkedIn, YouTube, Vimeo and Google+, and that it is responsible for processing the user’s personal data carried out through said social networks. It also informs the user that such data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD). Therefore, the following processing information is provided:

Why do we process your personal data?

Purpose of processing: to maintain a relationship between the USER and the CONTROLLER, which may include the following actions:

Processing requests and queries submitted to the controller.
Providing information about activities and events organised by the controller.
Providing information about products or services offered by the controller.
Interacting through official profiles.

On what legal basis may we process your personal data?

Legal basis for processing: Article 6.1.a GDPR, the data subject has given consent to the processing of their personal data for one or more specific purposes. The USER has a profile on the same social network and has decided to join the CONTROLLER’s social network, thereby showing interest in the information published on it. Therefore, when requesting to follow our official profiles, the user gives consent for the processing of the personal data published on their profile.

The USER may access the privacy policies of the social network itself at any time, as well as configure their profile to guarantee their privacy.

The CONTROLLER has access to and processes the USER’s public information, especially their contact name. This data is only used within the social network itself and will only be incorporated into a file belonging to the CONTROLLER when necessary to process the USER’s request.

How long will we keep your personal data?

Data retention criteria: the data will be kept until the USER withdraws the consent given, as indicated in this privacy policy.

To whom do we disclose your personal data?

Data disclosure: the information provided by the USER through the CONTROLLER’s social networks, including their personal data, may be published depending on the services used by the USER, and may therefore be made publicly available to other third-party users of the social networks. From the profile of each social network, the USER may configure what information they wish to make public in each case, view the permissions granted, and delete or deactivate them, as with any third-party application they no longer wish to use.

Rights available to the USER: these may only be exercised in relation to information that is under the control of the CONTROLLER.

2. USE OF THE PROFILE

The CONTROLLER will carry out the following actions:

Access to public profile information.
Publication on the USER’s profile of any information already published on the CONTROLLER’s social network.
Sending personal and individual messages through the social network channels.
Page status updates that will be published on the USER’s profile.

The USER may always control their connections, delete content that is no longer of interest to them and restrict with whom they share their connections. To do so, they must access their privacy settings.

3. PUBLICATIONS

Once the USER is a follower of or has joined the CONTROLLER’s social network, they may publish comments, links, images, photographs or any other type of multimedia content supported by the platform. In all cases, the USER must be the owner of the published content, hold the copyright and intellectual property rights, or have the consent of the affected third parties.

Any publication on the social network, whether texts, graphics, photographs, videos, etc., that infringes or may infringe morality, ethics, good taste or decorum, and/or that infringes, violates or breaches intellectual or industrial property rights, image rights or the law, is expressly prohibited.

In such cases, the CONTROLLER reserves the right to immediately remove the content, without prior notice, and may request the permanent blocking of the USER.

The CONTROLLER shall not be held responsible for content freely published by a USER.

The USER must bear in mind that their publications will be known by other users and that they are therefore primarily responsible for their own privacy.

Images that may be published on the social network will not be stored in any file by the CONTROLLER, although they will remain on the social network.

4. DATA OF MINORS OR PERSONS WITH SPECIAL CAPACITIES

Access and registration through the CONTROLLER’s social networks is prohibited for minors under the age of 18. If the USER has special capacities, the intervention of the holder of parental authority or guardianship, or their legal representative, will be necessary by means of a valid document proving representation.

The CONTROLLER shall be expressly exempt from any liability that may arise from the use of social networks by minors or persons with special capacities. The CONTROLLER’s social networks do not knowingly collect any personal information from minors. Therefore, if the USER is a minor, they must not register, use the CONTROLLER’s social networks, or provide any personal information.
